Kim Soo Hyun Investigation Effectively Ends After Prosecutors Request No Further Review

Police found insufficient evidence to pursue the child welfare and false-accusation complaints, while prosecutors returned the case without requesting additional investigation.

The criminal complaints filed against actor Kim Soo Hyun over allegations involving the late Kim Sae Ron have effectively concluded without prosecution.

According to reports published on September 8, prosecutors returned the case records to police on September 3 without requesting a supplementary or renewed investigation.

The Seoul Seongdong Police Station had already decided on July 29 not to refer Kim to prosecutors, citing insufficient evidence to establish violations of the Child Welfare Act or the offense of false accusation. Prosecutors subsequently reviewed the records but did not challenge that decision.

The development means the police’s non-referral decision remains in place after approximately 16 months of investigation.

However, describing the outcome accurately matters. It is not a verdict delivered after a criminal trial. It means investigators determined that the available evidence was insufficient to establish the alleged offenses and send Kim Soo Hyun forward for prosecution.

The complainants may still file an objection, although no successful challenge had been reported at the time of publication.

What Investigators Were Asked to Examine

Kim Sae Ron’s family filed a complaint in May 2025 alleging that Kim Soo Hyun had begun a relationship with the actress while she was underage and had engaged in conduct violating South Korea’s Child Welfare Act.

YouTuber Kim Se Ui, head of the YouTube channel Garo Sero Institute, also accused the actor of making a false criminal complaint after Kim Soo Hyun pursued defamation proceedings against him.

Kim Soo Hyun consistently denied having dated Kim Sae Ron while she was a minor. His representatives acknowledged that the two had been in a relationship but maintained that it began in 2019, after she had become an adult.

According to attorney Kho Sang Rock, who represents Kim Soo Hyun, investigators reviewed the broader period during which Kim Sae Ron was legally considered a child under the Child Welfare Act. He said the investigation was not limited to a narrowly selected period of her youth.

Police ultimately concluded that the evidence submitted and the surrounding circumstances were not sufficient to establish the alleged child welfare violations or false accusation.

Yonhap News TV reported the July 29 non-referral decision, while subsequent Korean reports confirmed that prosecutors did not request further investigation.

The Disputed Recordings and Messages Became a Separate Criminal Issue

The controversy grew rapidly after Kim Se Ui repeatedly released materials that he claimed supported allegations concerning Kim Soo Hyun and Kim Sae Ron.

Those materials included what was presented as a recording of the late actress and purported KakaoTalk conversations involving the two actors.

Investigators later concluded that a disputed voice recording had been created using generative AI and that alleged KakaoTalk messages had also been manipulated, according to Korean media reports.

Kim Se Ui was arrested in May on allegations that included spreading false information and defaming Kim Soo Hyun. Prosecutors indicted him in June, meaning those accusations will now be examined separately in court.

His criminal trial should not be confused with the complaints filed against Kim Soo Hyun. The police decision concerns whether sufficient evidence existed to pursue charges against the actor. Kim Se Ui’s case concerns allegations about how disputed evidence and claims were created and distributed.

Kim Se Ui has requested a jury trial, delaying the first scheduled hearing. The allegations against him remain accusations until decided by the court.

What the Decision Does and Does Not Establish

The latest development is legally significant for Kim Soo Hyun because he is not being prosecuted on the child welfare and false-accusation complaints based on the evidence investigators reviewed.

It does not automatically settle every public debate surrounding his past relationship with Kim Sae Ron. Nor does it amount to a court ruling on every allegation that circulated online.

The most accurate summary is narrower:

• Police found insufficient evidence to refer Kim Soo Hyun for prosecution.
• Prosecutors reviewed the records and requested no further investigation.
• The non-referral decision therefore remains in effect.
• The complainants retain a procedural right to object.

Kim Soo Hyun Has Already Begun Testing a Return

Even before the latest procedural development, Kim Soo Hyun had started cautiously rebuilding his public schedule outside South Korea.

He participated in an advertising shoot for Philippine clothing brand Bench in July and later appeared at Indonesian broadcaster RCTI’s anniversary event in Jakarta.

Kim has also been confirmed as an attendee at the 2026 Asia Artist Awards, scheduled for December 5 and 6 at Kaohsiung National Stadium in Taiwan. The appearance will place him alongside a large lineup of Korean and Asian entertainment stars.

These overseas activities suggest that the actor and his agency are moving beyond complete suspension. A return to major domestic acting and promotional work, however, presents a more complicated question.

The end of an investigation removes an important legal obstacle. It does not guarantee that Korean broadcasters, advertisers or audiences will respond immediately in the same way.

The Biggest Unanswered Question Is Knock-Off

The project most directly affected by the controversy is Disney+’s Knock-Off.

The crime series stars Kim Soo Hyun as Kim Sung Joon, an ordinary office worker who enters the counterfeit goods industry following the 1997 Asian financial crisis. Jo Bo Ah co-stars in the production.

Disney+ postponed the series in March 2025 as the controversy surrounding Kim intensified. Its future has remained uncertain despite repeated speculation about a revised release schedule.

In March 2026, Disney+ denied reports that Knock-Off was preparing for release that year. As of July, the platform continued to describe the project as being on hold, according to The Korea Times.

The latest investigative outcome may lead Disney+ and the production companies to review the situation again. However, no new release date has been officially announced.

The non-referral decision therefore should not be presented as confirmation that Knock-Off will be released.

Legal Closure Is Only One Part of a Comeback

Kim Soo Hyun entered the controversy after the extraordinary global success of Queen of Tears. Within weeks, advertising partnerships were disrupted, public appearances disappeared and one of Disney+’s most expensive Korean projects was placed on hold.

The decision not to prosecute him substantially changes his legal position. It gives his agency a documented investigative outcome to cite and allows the actor to resume activities without an active criminal investigation hanging over each appearance.

Yet a Korean entertainment comeback involves more than criminal procedure. Networks and advertisers must consider audience response, while Disney+ must evaluate a production involving a large cast, crew and financial investment.

For now, Kim Soo Hyun’s overseas appearances and scheduled attendance at AAA 2026 show that his return has already begun in limited form.

Whether that becomes a full domestic comeback, potentially including Knock-Off, will depend on decisions that investigators cannot make for him.
